These General Terms and Conditions of Sale apply exclusively between Carlotta Films SARL, 74 rue de Charenton 75012 Paris, and any person visiting or making a purchase via the website boutique.carlottafilms.com.
Any internet user can view the General Terms and Conditions of Sale on the website boutique.carlottafilms.com. As these General Terms and Conditions of Sale may be subject to modifications, the applicable conditions are those in force on the website on the date your order is placed.
CARLOTTA FILMS publishes the website boutique.carlottafilms.com (hereinafter referred to as "the website") and offers to purchase our products via the store (purchase of editorial products hereinafter referred to as "service").
The sale of products on the website is exclusively reserved for individuals and may in no case be used for commercial purposes.

1.3.1 Specifics of the Product Purchase Service
Since the Product Purchase Service involves shipping, processing fees will necessarily be generated.

For orders from a country other than Metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be applicable. These duties and sums are not the responsibility of Carlotta Films. They are the sole responsibility of the User, both in terms of declaration and payment to the competent authorities and/or organizations in your country. 1.6 Territory
The import of products purchased via the store is not subject to any territorial constraints.

Article 2 - Registration for Services
2.1 Account Creation
To place an order on the website, the User can create an account collecting their first name, last name, date of birth, address, postal code, and phone number. This account will be accessible using their email address and a password chosen by the User at the time of registration. A registration confirmation will be sent to the User's email address.
Account entry is only in French.
2.2 Personal Data

2.5 Account Closure
Carlotta Films reserves the right to close a User's account in the following cases: 1. Insolvency or payment problems; 2. Actions contrary to the provisions of the Intellectual Property Code; 3. User's failure to comply with any of their obligations under these terms.

Article 3 - Product Order
3.1
Once the order is validated by the User, it is final and cannot be modified or canceled. The User then receives a confirmation email, summarizing the various characteristics of their order. This email constitutes proof of the transaction and serves as an invoice. It is therefore highly recommended that the User keep and print it.
The order is binding on Carlotta Films only upon receipt of full payment of the price, and Carlotta Films reserves the right to refuse any order placed by a User who has not complied with the General Terms and Conditions of Sale during a previous order (for example: default of payment, violation of intellectual property rights, etc.).
Our Service offers and prices are valid as long as they are visible on the website and within the limits of available stock.
3.1.1 Specifics of the Editorial Product Purchase Service
Once the full price of the order has been collected by Carlotta Films, the selected product(s) will be sent to the address indicated by the User.
Carlotta Films cannot be held responsible for the consequences due to a delay in delivery.
For products not stored in Carlotta Films' warehouses, offers are valid subject to availability from Carlotta Films' suppliers.
In the event of product unavailability after placing your order, we will inform you by email or mail as soon as we receive information from the suppliers.
Any order placed on the website must correspond to the normal needs of a household.
3.2 Payment Methods
Payment is made by bank cards (Carte Bleue, VISA, Mastercard, Amex) at the time of order entry on the website.
During payment, the User must indicate, in the dedicated area, the number written on their card, its expiry date, and its cryptogram.
The User acknowledges that providing Carlotta Films with their bank card information constitutes authorization to debit their bank account in favor of Carlotta Films for the amount of their order, including fees and VAT.
The website is subject to a security system. No banking data is stored at Carlotta Films or on the boutique.carlottafilms.com website.
3.3 Withdrawal
In addition to the possibility of benefiting from the fifteen (15) day period (see next article), in accordance with our Returns Policy, you have the seven (7) day right of withdrawal provided by law to return items to us without having to provide a reason.
Shipping and return costs will then be at your expense. Only the price of the purchased product(s) will be refunded.

in their original and complete condition (packaging, accessory, manual, etc.), and accompanied by a copy of the invoice.
The right of return cannot be exercised when the products have been unsealed by the customer.
Items returned incomplete, damaged, or soiled by the customer will not be accepted.
Refunds for products in the cases mentioned above will be made within a period equal to or less than sixty (60) days after receipt of the products by us.
The refund will be made by bank transfer to the User's account.
No cash on delivery shipments will be accepted, regardless of the reason.
3.4 Product Conformity (exclusively reserved for the editorial product purchase service)
Carlotta Films undertakes to refund or exchange products that appear to be defective, damaged, or do not correspond to the User's order. In this case, Carlotta Films asks the User to report this in detail in writing and to return the product(s). Carlotta Films will proceed, at the User's choice, to exchange or refund the product(s). The request must be made within fifteen (15) working days following delivery. Any complaint made outside this period cannot be accepted.
In any event, the User benefits from the provisions of the legal guarantee, particularly those relating to the guarantee against hidden defects.
The provisions of this article do not prevent the User from benefiting from the right of withdrawal (satisfied or refunded) provided for in the preceding article.

Article 4 - Carlotta Films' Liability
Carlotta Films' liability cannot be engaged under these terms in the event of malfunction, interruption, inadequacy of the Service, or damage related to the User's equipment or the use of the Internet (slowdown, data loss, virus, intrusion, etc.).
Hypertext links present on the boutique.carlottafilms.com website may refer the User to partner sites. Carlotta Films' liability cannot be engaged if the content of these sites contravenes current legal and/or regulatory provisions.

The User must comply with the General Terms and Conditions of Sale for these products, and Carlotta Films cannot be held responsible for the uses that may be made of the products in this context.
 
Article 6 - Applicable Law and Dispute Resolution
These General Terms and Conditions of Sale are governed exclusively by French law.
In case of disputes, French courts have sole jurisdiction.
The User expressly acknowledges the probative force of electronic writing as used on the website and acknowledges that the data recorded by Carlotta Films is authentic and constitutes proof of all transactions made.
In the event of a dispute arising within the framework of the Services, the User will have the possibility, before any legal action, to seek an amicable solution, with the assistance of a consumer association or any other counsel of their choice.
