These general terms and conditions of sale apply exclusively between the company Carlotta Films SARL, 74 rue de Charenton 75012 Paris and any person visiting or making a purchase via the website boutique.carlottafilms.com.
Any Internet user can read the General Conditions of Sale on the boutique.carlottafilms.com website. These General Conditions of Sale may be subject to change; the applicable conditions are those in force on the site on the date you place your order.
CARLOTTA FILMS publishes the website boutique.carlottafilms.com (hereinafter referred to as “the site”) and offers to purchase our products via the boutique (purchase of editorial products hereinafter referred to as “service”).
The sale of products on the site is reserved exclusively for individuals and may not under any circumstances be used for commercial purposes.

The site offers online purchases via the store of products published by Carlotta Films.

Any person who has fulfilled the conditions of access to the Services and wishes to order one of these Services online is considered a User.

The price of the Services is that mentioned on the site. It is expressed in euros including all taxes (VAT and other applicable taxes). Orders will be invoiced on the basis of the rate in effect on the date the order is registered. Carlotta Films reserves the right to modify its prices at any time without notice.

1.3.1 Specific features of the Product Purchasing Service
Since the Product Purchase Service is subject to shipping, a handling fee will be generated.
In the event of an order from a country other than Metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be eligible. These duties and sums are not the responsibility of Carlotta Films. They are the responsibility of the User and are his/her sole responsibility, both in terms of declaration and payment to the competent authorities and/or organizations in your country. 1.6 Territory
The import of products purchased via the store is not subject to any territorial constraints.
Article 2 - Registration for Services
2.1 Creating an account
To place an order on the site, the User may create an account collecting his/her name, first name, date of birth, address, postal code and telephone number. This account will be accessible using his/her email address and a password chosen by the User at the time of registration. A registration confirmation will be sent to the User's email address.
Account entry is only in French.
2.2 Personal data
In accordance with the French Data Protection Act of 6 January 1978, amended by Act No. 2004-801 of 6 August 2004, and the General Data Protection Regulation (EU Regulation 2016/679), all Users have the right to access, obtain additional information, rectify and object to their personal data. 2.4 Use of the account
The User is solely responsible for the use of his/her account and password. Any connection or transmission of data made from this account will be deemed to have been made by the User and under his/her exclusive responsibility. The User therefore undertakes to immediately alert Carlotta Films in the event of fraudulent use of his/her account.
2.5 Closing the account
Carlotta Films reserves the right to close a User's account in the following cases: 1. Insolvency or payment problems; 2. Actions contrary to the provisions of the Intellectual Property Code; 3. Failure by the User to fulfill any of the obligations incumbent upon him/her under these terms.
Article 3 - Ordering products
3.1
Once the order has been validated by the User, it is final and can no longer be modified or cancelled. The User then receives a confirmation email, summarising the various characteristics of his order. This email constitutes proof of the transaction carried out and serves as an invoice. The User is therefore strongly recommended to keep and print it.
The order only binds Carlotta Films upon receipt of full payment of the price and Carlotta Films reserves the right to refuse any order placed by a User who has not complied with the General Conditions of Sale during a previous order (for example: non-payment, violation of intellectual property rights, etc.).
Our offers of Services and prices are valid as long as they are visible on the site and within the limits of available stocks.
3.1.1 Specific features of the order from the Editorial Products Purchasing Service
Once the full price of the order has been collected by Carlotta Films, the selected product(s) will be sent to the address indicated by the User.
Carlotta Films cannot be held responsible for the consequences due to a delay in delivery.
For products not stocked in Carlotta Films warehouses, offers are valid subject to availability from Carlotta Films suppliers.
In the event that a product is unavailable after you have placed your order, we will inform you by email or post as soon as we receive the information from the suppliers.
Any order placed on the site must correspond to the normal needs of a household.
3.2 Payment methods
Payment is made by bank cards (Carte Bleue, VISA, Mastercard, Amex) when the order is entered via the site.
The User must indicate during payment, in the area provided for this purpose, the number on their card as well as its expiry date and cryptogram.
The User acknowledges that communicating information relating to his/her bank card to Carlotta Films constitutes authorization to debit his/her bank account for the benefit of Carlotta Films up to the amount of his/her order, including costs and VAT.
The site is subject to a security system. No banking data is stored at Carlotta Films or on the boutique.carlottafilms.com site.
3.3 Withdrawal
In addition to the possibility of benefiting from the fourteen (14) day period (see following article), in accordance with our Returns Policy, you have the right of withdrawal of fourteen (14) days provided by law to return the items to us without having to provide a reason.
The shipping and return costs will then be your responsibility. Only the price of the product(s) purchased will be refunded.
Returns must be made to Carlotta Films, 74 rue de Charenton 75012 PARIS in their original and complete condition (packaging, accessories, instructions, etc.), and accompanied by a copy of the invoice.
The right of return cannot be exercised when the products have been unsealed by the customer.
Items returned incomplete, damaged, spoiled or soiled by the customer will not be accepted.
Reimbursements for products in the cases referred to above will be made within a period of less than or equal to sixty (60) days after receipt of the products by us.
The refund will be made by bank transfer to the User's account.
No cash on delivery shipments will be accepted, whatever the reason.
3.4 Product compliance (exclusively reserved for the editorial product purchasing service)
Carlotta Films undertakes to refund or exchange products that are apparently defective, damaged or damaged or do not correspond to the User's order. In this case, Carlotta Films thanks the User for reporting this in detail in writing and returning the product(s). Carlotta Films will proceed, at the User's choice, to exchange or refund the product(s). The request must be made within fourteen (14) working days following delivery. Any claim made outside this period will not be accepted.
In any event, the User benefits from the provisions of the legal guarantee, in particular those relating to the guarantee of hidden defects.
The provisions of this article do not prevent the User from benefiting from the right of withdrawal (satisfied or refunded) provided for in the previous article.

Carlotta Films cannot be held liable under these terms in the event of malfunction, interruption, insufficiency of the Service or damage linked to the User's equipment or to the use of the Internet network (slowdown, loss of data, virus, intrusion, etc.).

Article 5 - Intellectual property

Article 6 - Applicable law and dispute resolution
These General Conditions of Sale are governed exclusively by French law.
In the event of disputes, the French courts shall have sole jurisdiction.
The User expressly acknowledges the probative force of electronic writing as used on the site and acknowledges that the data recorded by Carlotta Films is authentic and constitutes proof of all past transactions.
In the event of a dispute arising in connection with the Services, the User will have the option, before any legal action, to seek an amicable solution, with the help of a consumer association or any other advisor of their choice.
